Who is ‘Married’ as per law ?

Procedure and Time frame

Indian laws related to marriage have become (rightly so) fairly strict in the last 10-15 years. Today, a Government issued certificate is a must for someone to prove that he / she in married. Various public and private institutions would insist on a certificate issued by a Government/semi Govt. agency as a proof of marriage. A marriage certificate today is as necessary as your passport, Aadhar card or PAN.

Is a marriage celebrated with presence of parents, relatives and all fanfare legal?

Surprising, the answer is ‘No’.

Celebration of marriage, inviting guests for reception, baraat, dance , vidhi, are just celebrations in legal terms. It doesn’t prove or certify that the marriage was actually solemnized in legal terms.

If there is no legal, Government certificate issued, marriage is not legal. Proving it otherwise becomes a legal issue. Either the bride or groom can just walk out of wedlock after 2-3 years and the burden of proof in on other party.

AryaSamaj2.0 strongly insists that every couple should obtain a marriage certificate from a legal authority immediately after marriage. An undertaking is signed by the couple during marriage. This simple piece of paper is a guarantee that legal rights of couple as individuals are protected well ( in case things do not work out well in future. )
